What this Agreement Covers
This Agreement delineates the terms governing your utilization of the Site and the Gummy Print service (referred to as the “Service”).
The Service facilitates customers with appropriate affiliations, including:
(i) institutions of higher learning, fraternal organizations, honor societies, and other collegiate groups (collectively referred to as “Institutions”);
(ii) corporations and small businesses;
(iii) elementary and secondary schools; or
(iv) other organizations, to create and procure custom merchandise accurately reflecting said affiliation.
By accessing the Site and utilizing the Service, you acknowledge your consent to abide by the terms and conditions outlined in this Agreement, and you agree to employ the Site and the Service strictly in accordance with the provisions herein.

Intellectual Property Rights of Gummy Print and Third Parties 

Gummy Print is dedicated to upholding the appropriate and lawful utilization of intellectual property belonging to others, and we expect our users to adhere to similar standards. Unless explicitly stated otherwise, all materials, encompassing images, illustrations, designs, icons, photographs, and written content, featured on the Gummy Print Site (collectively referred to as the “Contents”), are subject to copyright, trademark, trade dress, and/or other intellectual property protections owned, controlled, or licensed by Gummy Print.

The Gummy Print trademark is owned by Gummy Print; other trademarks accessible via this Site, such as logos, slogans, color schemes, and design trademarks (referred to as the “Licensed Marks”), are licensed for use by Gummy Print from Institutions and other third parties. By accessing the Gummy Print Site, you agree to restrict your utilization of Licensed Marks to activities directly related to said third parties and to adhere to any constraints or terms governing the use and access of the Licensed Marks stipulated by the third parties. Should your usage contravene these terms, Gummy Print will notify you accordingly.

In general, products crafted utilizing images available on the site should not be commercially resold. If you intend to resell such products, you undertake to contact Gummy Print beforehand to ascertain the legality of such resale. Designs generated using the text tools and images provided through the site do not confer exclusive ownership to customers who construct such designs. Gummy Print retains the prerogative to exhibit such designs or offer them (or variations thereof) to other customers.

Furthermore, Gummy Print reserves the exclusive right to reject any order that it deems defamatory, libelous, obscene, profane (according to standards established by Australian law), advocates irresponsible use of alcohol or other substances, promotes persecution based on gender, age, race, disability, or national origin, contains explicit sexual content, or is otherwise unsuitable for Gummy Print production.

You pledge not to utilize Gummy Print’s Service for creating any materials that are unlawful, detrimental, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, intrusive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable, or that infringes upon any patent, trademark, trade secret, copyright, or other proprietary rights of any third party.

Payment Policies

The pricing displayed on gummyprint.com.au is exclusively in Australian Dollars ($AUD).

Gummy Print facilitates online payments through credit cards, debit cards, PayPal, or Direct Bank Transfer. All electronically transmitted payments are securely conducted utilizing Secure Socket Layer (“SSL”) technology.

Additionally, Gummy Print may entertain purchase orders. Qualified Institutions, such as Purchasing Offices, seeking to establish group accounts and utilize purchase orders, may arrange special payment arrangements by reaching out to Gummy Print.

Upon verification of received payment, Gummy Print will promptly initiate order processing.

Shipment/Delivery Times 
Gummy Print’s orders are generally delivered within 2-10 business days.

Returns Policy
Gummy Print goes to great lengths to ensure that all orders are filled accurately and on time and are of the highest quality. Accordingly, Gummy Print accepts returns and will refund payment if and when customers are disappointed by Gummy Print merchandise for one of the following reasons: (a) the blank items themselves are materially flawed; (b) the quality of the decorating (i.e., the printing quality) is below a reasonable range of expectations; or (c) the design of the final product is materially different from the final design submitted by the customer.

Colour Matching
Gummy Print strives to provide the best possible prints however we cannot guarantee Pantone colour matching or RGB colour matching or exact colour matching with all designs. Colours may vary due to inks, design files and print media.

Proof Approval
Once your proof is approved, the design is considered final. No further changes can be made after approval. It is crucial to carefully review and confirm all aspects of the proof before giving the green light for printing.

Pixelation Disclaimer
By agreeing to these terms, you recognize that the quality of the print is dependent on the provided artwork. Should the proof display pixelation, the printed version will likewise reflect this. To optimize print quality, it is advised to submit high-resolution images and designs.

Colour 
Gummy Print production machines operate in CMYK colour profile for printing. Any RGB files provided will undergo automatic conversion to CMYK. Familiarity with the distinction between RGB and CMYK is essential for achieving precise and vibrant colors.

Order Modification
After placing an order, alterations can only be accommodated prior to proof approval. It is the customer’s responsibility to carefully review the proof for any errors or necessary changes.

Copyright
No trademarks or copyright material may be used. Only materials that you have the rights to use may be submitted.

Limit of Gummy Print’s Responsibility 
Gummy Print acknowledges responsibility solely for executing instructions received by Gummy Print. It disclaims liability for malfunctions in communication facilities beyond its control that may impact the accuracy or timeliness of your orders. Gummy Print assumes no liability for losses or delays in transmitting orders due to Internet Access Service Providers or issues with browser software, computer viruses, or related problems attributable to such providers. Gummy Print bears no responsibility for incorrect instructions provided or failures in credit card processing by credit card companies.

The information and materials provided on this Site, including text, graphics, links, or other items, are presented “as is” and “as available.” Gummy Print makes no warranties regarding the accuracy, adequacy, or completeness of this information and materials and expressly disclaims liability for any errors or omissions. No warranty, whether implied, express, or statutory, including but not limited to non-infringement of third party rights, title, merchantability, fitness for a particular purpose, or freedom from computer viruses, is provided concerning this information and materials.

Under no circumstances will Gummy Print be liable for damages, including but not limited to direct, indirect, special, incidental, or consequential damages, losses, or expenses arising from the use of this site or inability to use it by any party. This includes any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus, or line or system failure, regardless of whether Gummy Print or its representatives have been advised of the possibility of such damages, losses, or expenses.

Indemnity 
You agree to indemnify, defend, and hold harmless Gummy Print and its affiliates from any and all claims, damages, costs, and expenses, including reasonable attorneys’ fees, arising from your use of Gummy Print’s Site and the Service, your breach of this Agreement, or your infringement of any rights of another party.

Governing Law 
This Agreement shall be governed by the laws of the Commonwealth of Australia.
